The name “Architerra Designs” is a trademark of Architerra Designs. The site enables you to buy selected product and services via Architerra Designs (the “Products”).

Modification to This Agreement

Architerra Designs may change this policy at any time without notice. An annual policy update will be emailed to all active Customers at the end of each calendar year. The Customer terms do not require reaffirmation annually upon initial acceptance.

Disclaimer and Limitation of Liability

Use of Architerra Designs and any information obtained from the website is at your sole risk. Architerra Designs shall not be liable for any loss, punitive, incidental or consequential damages or any claim against Architerra Designs by any other party. UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL ARCHITERRA DESIGNS, ITS SUPPLIERS AND ITS THIRD-PARTY AGENTS BE LIABLE TO YOU FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES, EVEN IF ARCHITERRA DESIGNS HAS BEEN ADVISED SPECIFICALLY OF THE POSSIBILITY OF SUCH DAMAGES, ARISING FROM USE OF OR INABILITY TO USE THE SERVICE OR ANY LINKS OR ITEMS ON THE SERVICE OR ANY PROVISION OF THE TERMS OF SERVICE. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages.

Choice / Opt-Out

As a condition of completing a transaction on Architerra Designs’ website, the Customer has chosen to opt in for any electronic communication. Architerra Designs requires a written notice from the Customer to remove that Customer from the mailing address by submitting the request to info@architerradesigns.com.

Social Media

Customers understand that Architerra Designs does not in any way screen its Customers, nor does it attempt to verify the information posted by its Customers. Architerra Designs makes no representations or warranties as to the conduct of Customers posting reviews or other social media content. In no event shall Architerra Designs be liable for any damages whatsoever, whether directly or indirectly, arising out of the use of its website. You (the Customer) are solely responsible for the content or information you publish on this website. You will not post on the website inaccurate, abusive, offensive or illegal material, or any material that infringes or violates another party’s rights (including, but not limited to, intellectual property rights and rights of privacy and publicity). Architerra Designs reserve the right, but has no obligation, to reject any information or photo that does not comply with the prohibitions sets forth in this section. Architerra Designs reserves the right to refuse service to anyone, at our sole discretion.

General Terms and Conditions

As a Customer of this service, you agree:

1. You will not post or send any content or engage in any conduct that subjects Architerra Designs to any threat of civil or criminal penalties.

2. You understand that negative posts via any social media sites that are managed by Architerra Designs are subject to removal if internally deemed untrue or inappropriate.

3. You assume all liability for use of any information you find on Architerra Designs’ website.

4. You have the authority to enter into this agreement by being at least 18 years of age.

Indemnification

You agree to indemnify and hold harmless Architerra Designs, its officers, directors, shareholders, and agents from any damage suffered directly or indirectly as a result of your use of its service. You agree to pay any and all costs, damages and expenses, including, but not limited to, reasonable attorneys’ fees and costs awarded against or otherwise incurred by or in connection with or arising from any such claim, suit, action or proceeding attributable to any such claim. Architerra Designs cannot and will not act as a mediator or arbitrator between Customers in any dispute arising from the use of the Service.

Right to Assign

Architerra Designs may assign its rights to this Agreement without the Customers’ consent. If Architerra Designs assigns its rights, is sold to another entity, or enters into an agreement with another company to share information, Architerra Designs or its successor will give notice to the Customer within 30 days of the transaction completion.

Legal Action and Enforcement of This Agreement

If a dispute arises between any Customer of the website and Architerra Designs, any legal action will be brought exclusively in Washington State, United States of America, in accordance herewith and the laws of Washington State shall apply without regard to any other choice of law considerations. Any dispute which arises out of or is related to this Agreement shall be resolved by BINDING arbitration conducted by a retired judge of the superior court or an impartial person chosen from a list supplied by the American Arbitration Association to hear this matter in Washington State, United States of America, using the American Arbitration Rules of Commercial Arbitration. The parties shall initially both bear their own costs of the arbitration. The prevailing party in any BINDING arbitration or Court action arising out of or relating to this Agreement shall be entitled to recover costs, expert witness fees, attorneys’ fees and arbitrator’s fees. By using or continuing to use the website of Architerra Designs, you agree to the terms and conditions of this Agreement.

• Architerra Designs does not sell, rent or exploit the individual information provided by the customer for marketing purposes. Individual information includes name, address, phone number or method of payment.

• You are consenting to the use of this information in an effort to create a profile of interest, future internal marketing and any other preferences and browsing patterns that Architerra Designs creates to add value to the Customer.

• Architerra Designs may share your personal information for the purpose of delivering an e-mail to you, obtaining a debit that is outstanding or as required by law.

Usage Information

In addition to collecting personal and non-personal information, Architerra Designs may also collect non-personal, aggregated information about Customers’ use of the website. This information is not personally identifiable and will only be used to find out how Customers use the Architerra Designs service and website. For example, this information will tell us how much time Customers spend on our site, from which other sites Customers came, and to what other sites subscribers go.

Tracking

Like most sites, Architerra Designs makes use of browser “cookies.” Cookies are small text files placed on your computer’s hard disk by Architerra Designs’ server. They allow Architerra Designs to quickly check your status as a Customer so Architerra Designs can take you directly where you want to go. IP Addresses or other passive information collection technologies may be used. Architerra Designs will never use cookies to retrieve information from a computer that is unrelated to our site or product. Cookies might be used for advertising purposes. Architerra Designs reserves the right to share tracking information to enhance the Customer’s experience towards customizing content.

Data / Security

All information described in this privacy policy is stored on restricted database servers. In the event that there is any type of security breach, Architerra Designs will notify its Customers via electronic communication within 90 days of confirming the extent of the breach. Architerra Designs subscribes to encryption technology to include the latest SSL transmission. We do not have restricted database servers at subscribers go.

Pricing and Ordering

For trade pricing list please send a request to info@architerradesigns.com with a copy of your current reseller permit.

Ordering

To process an order we will first require a purchase order to provide you with a price quote. You will be responsible for providing a purchase order. We will then issue a price quote within 24 hours of receiving your purchase order. We will then require a written order confirmation.

Once received, we will issue an invoice for a 50% deposit. Once deposit is received Shop drawings will provided within 7-10 business days. All lead times are in effect upon the receipt of the approved shop drawings. Balance due must be paid before your order is shipped.

All Price quotes are valid for 30 days from the date they are issued. Changes to quantities may require a revised quotation. Pricing, as quoted, is based on conditions prevailing at the time of your order. Permissible variation in quantities will be to the seller’s standard practice.

Our Base products are shipped via UPS Ground. We offer carrier freight on large quantity orders. Our Base products have a lead time of (discuss with Clayton)

To check the current status of an order please call 360-502-6344 or email us at info@architerradesigns.com Monday – Friday. Emails are typically answered within 24 hours. While lead times may vary, 6-8 weeks is standard. Specific lead times will be provided at the time of your order.

Shipping

Customers receive all products via a shipping carrier chosen at the discretion of Architerra Designs.  Architerra Designs does not require signatures or other methods of verifying delivery. It is the Customer’s responsibility to ensure there is a safe and secure place for delivering the Customer’s purchased products. Architerra Designs is not responsible for the shipment once it has been delivered to the Customer’s residence or place of business. The Customer’s shipment is sent directly to the address provided within the purchase of the product. Shipping times are estimates. Architerra Designs cannot guarantee arrival timelines even if the Customer incurs expedited shipping charges. Alterations or special shipping instructions can be handled by contacting customercare@architerradesigns.com.

Architerra Designs only ships to the Continental United States at this time.

Coupon Acceptance

Architerra Designs accepts coupons issued by the company. Architerra Designs does not accept nor match any competitor or big box coupons on like/like product. The decision of whether to honor coupons is at the sole discretion of Architerra Designs. Coupon acceptance will be validated on the shopping cart checkout page. The coupon must be entered as it is displayed in physical form, meaning capitalization, spaces or specialized symbols should be replicated when typing the information into the coupon field. A coupon will only be valid with a unique email address, thereby eliminating the ability to reuse a coupon multiple times.  Stacking of coupons on a single transaction is strictly prohibited and will not be honored.

Trade Discounts

Architerra Designs allows select wholesale and trade discounts. A trade discount is defined by a legal entity in a related industry for resale. A wholesale discount is defined by an established LLC or formal corporate entity that sells products retail or to the trade in a related industry. To understand if eligible, the Customer must email or phone into sales@architerradesigns.com / 360-502-6344. A support person will provide the details. Architerra Designs does not publish nor guarantee that a trade discount will apply to any transaction outside of the authorized use at the time of issuance.  

Credit Card Authorization

Architerra Designs does not process or authorize payments submitted by the customer. Architerra Designs subscribes to a service that approves or denies the requested transaction amount. Information pertaining to the denial of a requested transaction should be directed to the Customer’s credit card issuer being used for payment. Architerra Designs reserves the right to provide transactional information to a credit card provider in the event of a dispute arising from a Customer.

Refund / Return

Architerra Designs allows for a 15 day return window on any unused retail products purchased via the website. Conditions of the return are as follows:

1. A 15% re-stocking fee will be assessed for any open box return that is not damaged. Wholesale and trade sales are final.

2. Any applicable tax refund will be issued minus the re-stocking fee holdback.

3. A return-shipping label will be provided via customer care.

4. A refund will be processed using the same payment method within 5-7 days after receiving the original product back minus the processing costs. Individual banks may require an additional amount of time to process the refund before placing it back onto the Customer’s payment method.

If a product is damaged in shipping, notification to Architerra Designs’ customer care within 5 days of receiving is required.

If a product is deemed damaged after set-up, a like/like replacement will be issued to the Customer upon receipt of the damaged product. In the event a like/like replacement is no longer available, the Customer will be given an option for an alternative replacement or a refund

Sales / Tax

All products sold are prohibited for resell by any entity unless expressly authorized by Architerra Designs. Architerra Designs does charge sales tax per transaction, unless a resale certificate is on file. The sales tax amount may vary by the individual’s geographic location defined by the Customer’s zip code at the time of check-out on the website. The sales tax amount will be in accordance with the Washington state laws of online product or services at the time of checkout.

Satisfaction Guarantee

Architerra Designs wants to make sure all customers are enjoying the Architerra Designs service.  To insure this, Architerra Designs offers a 100% satisfaction guarantee on all new retail orders. If you are not completely satisfied with Architerra Designs you may contact us for a refund minus shipping and restocking costs within 15 days of the transaction purchase. 

Price Changes

Product prices are subject to change without notification. Prices may change based on market conditions, general availability or other undefined factors. Architerra Designs does not notify Customers of price changes. Leaving a product inside a shopping cart without completing the transaction does not guarantee the price of that product. All prices are valid only at the time of completing the checkout process.
